New Mexico Personal Injury Attorney
If the death of someone you love was caused by the negligence of another person, there is little anyone can do to ease the pain. While no compensation can ever make up for the loss of a loved one, you and your family should not have to endure unnecessary financial hardships as well. By law, you have the right to file a claim for wrongful death to recover damages.
A wrongful death may happen anywhere at any time. These are a few events that could result in a New Mexico wrongful death claim:
- Medical malpractice in the form of error, misdiagnosis, incorrect prescriptions, or inaction;
- Motor vehicle accidents in which the at-fault driver is evidenced to have been under the influence of drugs or alcohol, cell phone use, or other negligent behavior;
- Defective products that cause death during use;
- Workplace accidents in which the employer failed to provide a safe environment and/or safe equipment;
- And more.
In New Mexico, the wrongful death law states that, prior to filing a case, a wrongful death personal representative for the estate of the deceased must be appointed. This representative can be anyone with the knowledge and interest necessary to pursue the case (i.e. an attorney, friend, family member, etc).
The New Mexico Wrongful Death Act requires that any recovery be distributed pursuant to established statute. No judgment shall be subject to any debt of the deceased, provided the decedent is survived by a spouse, child, father, mother, brother, sister, or child, as defined in the New Mexico Probate Code.
If someone you love has his or her life due to the negligence of another, it is important to contact an attorney immediately. In New Mexico, the statute of limitations is three years to file a claim. If your lawsuit is against a government entity, the statute of limitations may even be shorter.
Immediately after the loss of a loved one, you may not be concerned with finances, bills, or lawsuits.
