The New Mexico Wrongful Death Act requires that any recovery be distributed pursuant to established statute. No judgment shall be subject to any debt of the deceased, provided the decedent is survived by a spouse, child, father, mother, brother, sister, or child, as defined in the New Mexico Probate Code.
